The applicant has requested a one year time extension of final approval and has paid the fee. This project will now expire December 11, 2014.

Vaughn and his wife met with staff today to discuss options with the common area. There are concerns with the HOA owning and leasing the management of the stables verses compensated value to the developer. Sec. 108-3-7-f of the Land Use Code requires that common areas owned by lot owners are to be a minimum of 10 acres. Options around that requirement were discussed as 1) Variance to standard 2) Code text amendment 3) Standard lot design 4) Zoning Map Amendment 5) not developing and 6) Developing just one lot at a time. Also it was noted that the expiration of this subdivision is due(12-12-13), the owner was given until 2-10-14 to make a request for a one year time extension.

This office has completed its 3rd review of this subd with the redlined review entered and emailed to Chris at Reeves and Assoc. (1) All property will need to be in one ownership prior to recordation. (2) Owners dedication will need to address the "Open Space". Who owns it? Is there an H.O.A.? These items will require addressing and have been noted on the review plat.

In the new documents that have been submitted there does not appear to be any information that pertains to my review dated September 26, 2012. However, in briefly looking at these plans there are a few questions that would arise. I believe that there was detention required as part of the Allen Riding arena and the drainage and detention should be shown on the plan. I also see that there is an area marked as restrooms. These restrooms will need to hook to the sewer.

Water connections will all be installed by the water district fire hydrants must be installed by a bonded contractor. District will need a copy of thier bond. water rights must be submitted to district before any building may begin.

After meeting with the owners several times over the past week. It was determined that this subdivision would not seek revision, and proceed with the common area to be owned by the HOA. The HOA could however lease space for the management and the maintenance of the equestrian training facilities. The owners will prepare to move forward towards final approval and completion of agency requirements.
