Proposed Language for the trail easement on the adjacent property. We, the undersigned owners of the herein described tract of land, do hereby intend to dedicate to public use all those parts or portion of said tract of land designated as public access easements, the same to be used as public access easements and also do grant and dedicate a perpetual right and easement over, upon and under the lands designated hereon as public access easements, the same to be used for the installation, maintenance, operation of public pathways, with no buildings, obstacles or structures being erected within such easements. Such dedication will take place only upon the subdividing of said tract of land by the owner, its successors or assigns.

The original soil work associated with this parcel was performed in July 2007 to determine the feasibility for a 5 lot subdivision. At which time all lots were 3.0 aces plus. The new cluster proposal consisting of 7 lots approximately 1.0 acres in size will have to do additional soils work to meet the R317-4-4.2.C Subdivision Onsite Wastewater System Feasibility Determination. Each proposed lot shall have at least one soil exploration pit, percolation test, or both. A map or GPS location of the previous soil evaluation test pits can be obtained from our office in person or via email. Please contact our office at 801-933-7160
