The subdivision plat and other agreements were recorded on May 21, 2012.

The mylar plat has all of the required signatures and is ready to be recorded. All of the required agreements have been signed except for the deferral agreement, which is prepared and ready for a signature. The County Commission approved the subdivision on May 15th.

Cliff Bell brought in the escrow check, mylar and SWCAP. He spoke to Sean Wilkinson and was told he would be on the agenda for the County Commission meeting next Tuesday. Mylar is waiting for the County Engineer to sign it.

Cliff Bell was in today, he gave me the SWPPP and I gave him the SWCAP to fill out and return as well as a blank escrow certificate. He asked me to set up a meeting Jared to discuss the escrow amount. When he comes in for the meeting he will have an approval from Ted Black and the mylar, hopes to get on the agenda asap.

I spoke to Cliff Bell on the phone this morning about getting the ditch piped. I informed him that I've spoken to the County Engineer and the only way we can allow him to pull a building permit or record the mylar is to put up an escrow for the materials and installation (even though he's already purchased the materials) or get the improvements installed. He isn't able to install the improvements until October due to the water being turned into the ditch. As we were talking, he indicated the ditch was on private property and not in the right of way. I told him to get something from his surveyor showing me that. If the ditch is not in the County right of way, I can't required it to be piped. He said he would get that information for me.

I met Cliff Bell on site, we reviewed the plans for piping the irrigation ditch. Water will be turned into the ditch any day so he asked if he could buy all the materials and put up the escrow for the labor. I told him that was fine, but when I got back to the office I was told that wasn't okay. We will make an exception in this case and let him do what I said was okay but he won't be able to pull a building permit until the improvements are installed. I called Cliff and left him a message about my mistake.

I spoke to Cliff Bell this morning, he is now working on this project and has another buyer. He called to find out where the project stands and what is left to be done. I will be meeting him on site today to go over everything.

I received the following reply from Kent Buie on November 1, 2011: Mark LIndsley, our buyer, failed to close. We are holding the mylar of a while to see if he circles back after the first of the year. Without a buyer we can not justify installing improvements. BTW - tried to reply to Miradi but could not log in nor reset username PW without success.

I just talked to Kent Buie on the phone about the escrow. He doesn't want to escrow for the all the improvements. I told him that after final approval of the plans, and a pre-construction meeting he can install the improvements with all required inspections. If they do that then they only have to escrow the 10% contingency for the warranty period.
