In the recorded development agreement, under "Recitals", the first 2 paragraphs state 13 detached single-family dwellings and then 13 single family lots. Under section 7.2, the agreement states "the use of the Project shall be limited to ten (10) detached single-family residential lots. Should this document be updated to reflect what has been approved by the Commissioners which is the 10 residential lots as stated in section 7.2?
This rezone was approved mid-2021 in accordance with the planning commission's recommendation. However, at that time no formal rezone ordinance was adopted and nor formal development agreement was executed. It is now scheduled on January 18, 2022 for the County Commission's final approval with an ordinance and a development agreement that restricts the development to no more than 13 single-family dwelling units and with no allowance for the short-term rental of those dwellings.
This application was considered by the planning commission in their April 27, 2021 meeting. After a public hearing, the planning commission recommended that the county commission approve the rezone. Their recommendation included a stipulation for the rezone to be approved with a development agreement prohibiting nightly rentals.
