The Weber County Planning Office has received a request to vacate all of Lot 13 Liberty Meadows Subdivision as part of a plat amendment to correct the location of a drainage easement and to reconfigure the lot lines. Notice is hereby given that the Ogden Valley Township Planning Commission will hold a public hearing on May 5, 2015 at 5:00 PM in the Commission Chambers (1st Floor, Weber Center, 2380 Washington Blvd. Ogden, Utah) regarding the vacation of Lot 13 in the Liberty Meadows Subdivision, located at 3807 East 3600 North Eden, UT. Copies of the proposal may be reviewed prior to the hearing in the Weber County Planning Commission Office, Suite 240, in the Weber Center. Additional information may be obtained by contacting Ronda Kippen, Planner II, at 801-399-8768. Meeting date and time is subject to change. I spoke with Wasatch Civil today regarding the status of the revisions for the reconfiguration of the subdivided parcel that is running concurrent with the plat vacation for the existing Lot 13 in the Liberty Meadows. Corrections are expected in near future.

There has been question over the requirement for where the new easements should be located. It is requested that a survey be made of the location of the easterly high waterline of the stream and then a determination if this is a year round stream or an ephemeral stream . per section 108-7-23 river and stream corridor setbacks (a) (2-3). It doses seam to fit the definition of a stream under sub section (c) of the same ordinance as it appears as a Blue Line Stream on the current USGS Quad Maps. If these indeed are correct then the requirement of item ! above will be amended per the code. No new development should be considered within 50 feet of the high water marks of the stream. It is recommended that drainage easements be set at 20 feet either side of the center of the stream consistent with that proposed for vacation these may straddle the easterly property lines so that area of easement occurring with the new parcel will be considered to supersede Item 1 above.

1. Keep the 40 foot wide drainage easement as proposed. Extend a 20 foot wide drainage easement to the north lot line of lot 24 along the east property line and extend a 20 foot wide drainage easement south westerly along the easterly property line bearing S 40 Deg. 09 Min. 15 Sec. W the length of said boundary (211 feet +/-). 2. Provide a recorded right of access to Weber County from 3600 North Street across lot 24 for maintenance of the existing natural drainage course and the proposed drainage easements provided therefore.
