Application

Digis is requesting approval of a conditional use permit for a wireless internet transmission site. This transmission site is located on top of the water storage tank within the Legends at Hawkins Creek.  Although this transmission site is small (approximately 56 square feet and 10 feet tall) it falls in the same category as a cellular tower, which is considered a public utility substation.  The FV-3 Zone, where this is located, allows a “public utility substation” as a conditional use. The location was chosen because it is high above the valley floor and provides adequate visual line of site, which is required for the wireless transmission to work properly. This site will allow Digis to provide better wireless internet service to its customers in the Ogden Valley.  The applicant has a current lease agreement with the Legends at Hawkins Creek Home Owners Association (HOA) and the conditional use application was signed by its managing member.

Digis has been approved Ogden Valley Planning Commission for a new site and this site will be abandon

An e-mail was sent to Blaine Benard asking for an update on the status of a potential agreement between Digis and the HOA. The last correspondence prior to this e-mail was on December 19, 2013.

The appeal hearing was held on February 12, 2013. The County Commission upheld the Planning Commission decision and denied the appeal. Digis is required to come back before the Ogden Valley Planning Commission because the original conditions of approval have not been completed.

An appeal of the Planning Commission's decision on January 3, 2012 has been filed with the County Commission. The hearing date is currently scheduled for January 29, 2013.
