Application

A new development of previously agriculture land has been submitted. The County roadway that was originally agreed upon was 33 feet on each side of the property line. The Developer has requested the future roadway footage is moved from their side and moved onto the agriculture property to accomodate their building plans. This is an appeal to move the footage back to the agreed upon 33 feet to the Developers property and not burden the agriculture land with this future road requirement.

Section 106-2-1 Street Configuration

General street configuration and alignment:  The configuration of streets in a new subdivision shall (4) Not avoid the requirements of this section by shifting the responsibility of providing a street onto landowners of adjacent undeveloped or underdeveloped parcels; and (5) Not create an unnecessary hardship to providing street connections on or to other parcels in the general area, as deemed appropriate by the Land Use Aurthority. 

The road per Mr Butler plat has been shifted onto our adjacent undeveloped property.  Please take this into consideration when completing this review.  Our property is used for agriculture purposes and moving the responsibility of providing additional land from our adjacent property to accommodate a developer is not an equitable solution and should not be allowed.
