I Did another site inspection on 5219 North North Fork Road. I had done a previous inspection in the summer (2013) on the request of an anonymous caller at that time I did not find anything other than two recreational vehicles with current tags. This time I found one other recreational vehicle and a car as well.

The property owner arrived on site when I was there and we started discussing what was going on with his property. He did let me know that he and his wife do reside on the property when they are not hosting at the camp sites for Weber County during the summer months. I talked to him about the zoning rules, that is when he informed me that he does have a legal septic that it was approved by the County, also that his property was recreational when he purchased it. He said he was not aware that it was AV-3.

I asked him to find his paperwork and bring it into the county so we could discuss it further, I also said anything he could find that said his property was recreational might also help.

I did inform him I would give him a week to find any relevant paperwork before I sent him a notice.

May 18th 2016, Reported to Judge Waterfall that the property had not been touched and presented photographs Mr. & Mrs. Van Alfen explained that they had lost the written inventory and photographs and didnt know what to do, Judge again gave Code Enforcement 30 days to make another inventory and get it to the Van Alfens.

May 17th 2016, Drew up another Warrant to access property to make a further record to see if junk had been cleaned up. Mr. & Mrs. Van Alfen were not at home. A Deputy Sheriff accompanied Code Enforcement at time of inventory.

May 4th 2016 Reported to Judge Waterfall that the property had not been touched and presented photographs of before and after. Mr. & Mrs. Van Alfen explained that they had cleaned up all they were going to clean up and the Judge could shove it. Mr Van Alfen also informed the Judge that they were related and that he was related to the Govenor and that the Govenor was not happy with Code Enforcment. The judge said that the courts would inpose the fine, $400.00 and Mrs. Van Alfen started crying and the Judge asked if they had cleaned up anything that is when Mrs. Van Alfen said that thay they had employment in the valley and hadn't had any time to do any thing. The Judge asked when would it be cleaned up or did he need to send in the County. Mr. Van Alfen said he would need at least three or four months more. At this point the Judge said he would give thyem two weeks to get their act together and get something acomplished.

Tuesday April 12th 2016 Mr. & Mrs. Van Alfen came into the office demanding the written inventory met with Director Rick Grover, Code Enforcement Officer Iris Hennon and Mr. & Mrs. Van Alfen explained that Code Enforcement had thirty days to compile the written inventory, but informed them as soon as it was done I would drive it by their trailer.

Monday April 11th 2016 Otained a Warrant to enter property from Second District Court. Called dispatch and was given three deputy sheriffs to accompany me on this inventory of junk on the property.

Friday April 8th 2016 Mr. & Mrs. Van Alfen refused to allow Code Enfforcement access to the property citing that they are sovereign citizens and not subject to the courts ruling he also indcated that he had all sorts of things in his trailer including a gun and his father had taught him well hunting and fishing so he knew his rights and as he had a sign no trespassers on his property so if someone came on his property he was only defending himself. At that point I excused myself.

Wednesday, 6th April 2016 Judge waterfull made a ruling to circumvent any miss understandings that Mr. & Mrs. Van Alfen might have. They had been found guilty and a plea was recorded and it was only through Code Enforcement efforts that an order hasn't been issued by the court for the County to enter the property and clean it up and bill the Van Alfen's. The Judge wanted Mr. & Mrs. Van Alfen to thoroughly understand that Code Enforcement will enter the property make a written list inventorying any and all junk on the property giving a copy to Mr. & Mrs. Van Alfen as they cannot see the junk in the photographs provided to them. Code Enforcement will have two weeks to acomplish this task and provide the Van Alfens the written record.

Monday, April 4th 2016 Made several attempts with the residents by phone and by written notice to come and do an inspection a Visual inspection with photographs to document how the clean up was coming and how close they were to compliance for Justice Court and Judge Scott Waterfall the presiding Judge. This they refused and so I notified the attorneys office and was instructed to wait and report to Judge Waterfall.

Tuesday 7th October, Talked to the Prosecutor about this case the plan is to go tomorrow and evaluate the property. If it is not clean to push for a closer court date.

Thursday 8th May, I did another inspection on the property and found that the recreational vehicle that they live in has been moved some junk has been cleared and more needs to be done. There is still a recreational vehicle on the property which I was informed by the Son in Law belongs to his son.I sent a reminder notice to Mr. & Mrs. Van Elfen to continue cleaning up the property.

Wednesday March 5th 2014, Planning Director Sean Wilkinson again met with Mr. & Mrs. Van Elfen and discussed doing a subdivision with them and gave them some direction.

Friday Feb 28th 2014 Mr. & Mrs. Van Alfen met with Building Official Craig Brown to submit their idea for Converting 200 square feet of their barn into living quarters. I again talked with them about their vehicles that are unlicensed and the junk on the property.

Wednesday Feb 26 2014 The Planning Director Sean Wilkinson discussed the records request with Deputy Attorney Christopher Allred and he gave the Planning Division direction to deny the request. Your request for a record dated ________________ is denied. The record is classified as Private under Utah Code Ann. §63G-2-303(2)(d) because it contains “data on an individual the disclosure of which constitutes a clearly unwarranted invasion of personal privacy.” Pursuant to U.C.A. §63G-2-401, you have the right to appeal this decision within 30 days to the Weber County Commission, whose business address is 2380 Washington Boulevard, Ogden, Utah 84401.

Tuesday Feb 25th 2014 Mr. & Mrs Van Alfen, Contacted the County Commissioners and voiced their opinion that they were not happy with the outcome of their meeting and asked them to intervene. The Planning Director Sean Wilkinson was contacted and contacted the Van Elfen’s and asked them to meet with him and discuss their displeasure. One of their objections was that they wanted to know who the neighbor was that had called in and gave the County the information that they were living out of a trailer. They did fill out a (Grama request), request for records.

20th Feb 2014, Mr. & Mrs. Van Alfen came in today to talk about the prior information that they had talked about in our first meeting. Mr. Ben Hatfield Staff Planner, was already engaged in conversation with the couple when I arrived in the office. We talked about how we could best resolve this issue about them living on their property. I also invited Mr. craig Brown the Building Official to enter in the conversation to help Mr. Mrs. Van Alfen. We came up with a plan that they could convert part of the garage into a living space. I also recommended that as soon as they could get a plan together for the living space and have it submitted, we could use. Sec 108-7-20 Occupying recreational vehicles. Sec. 108-7-20. Occupying recreational vehicles.(b) Occupying a parked recreational vehicle, by the property owner, may be permitted for a period of six months on the property where a home is under construction, provided that the recreational vehicle is hooked up to an approved wastewater disposal system. They were also very apologetic about their unruly behavior the previous meeting and left smilling. Mr. Ben Hatfield Staff Planner, also discussed with them the Possibility of subdividing their property as they wanted to subdivide into 1/2 acre lots, or one acre lots, he also discussed making the lot legal.

10th feb 2014, Met with Mr.& Mrs. Van Alfen, Mr. Ben Hatfield Staff Planner, to discuss on going problems with their property as well as the problem of them living in a 5th wheel travel trailer. They also have some junk, unlicensed vehicles which need to be addressed. Mr. & Mrs. Van Alfen became quite stressed and somewhat unruly shouting and such. When they left Mr. Ben Hatfield Staff Planner and myself thought we had been able to Calm them down and that they could understand what we were saying. Mr. Ben Hatfield and I met with the Planning Director Mr. Sean Wilkinson to see if there any other ways that we could help this couple. I did discuss with Ms.Jennifer Graham Director of Parks and Recreation their situation as I was advised by the Van Alfen's that she would call. Ms. Graham did call to discuss their situation and we discussed possable Solutions. 1. they could live for 7 months at one camp site and the other 5 months at an other whuch would benefit the County as they would serve as night watch man.
