This property has a duplex on one acre.

In 1979 the home was build as a single family dwelling four (4) bedrooms, three (3) bathrooms one (1) half bath, one(1) kitchen home sitting on 62.49 acres. In the zoining ordnance 1976 chapter five (5) a two family dwelling you are requiried to have a minimum lot size of two (2) acres.

In 1996 approximately 0ne and a half (1 1/2) acre subdivision on the east side of the property was broken off. which left sixty one (61) acres with the home.

In 1999 one (1) acre with the house was made into the Lena Degiorgio subdivision. There is nothing in the file to indcate that it was a duplex at the time the subdivision was created.  

The data on the appraisals collected from the assessors office show that it was a single family home.

The tax information indicates that it was a single family home from its inception in 1979 through 2009 and in 2010 it changes to multiple housing.

May 28 2013, Had a meeting with Representative Gage Froerer concerning Mr. Costesso violation. Assistant Director Jim Gentry was also present at the meeting. It was decided the best way that Mr. Costesso could resolve the problem was to apply and do a text amendment change to the ordnance to allow a larger square footage for accessory apartments. At present it is no more than eight hundred square feet.

Mr. Costesso came to the office this morning and asked about the application procedure for an accessory apartment. We found that his apartment is larger than 800 square feet and does not meet the standards for an accessory apartment. I informed him that he could reduce the apartment size, apply for a text amendment, or purchase additional property to bring the lot up to two acres (which would allow for a two-family dwelling). He took the text amendment application and said he would look at purchasing additional property or submitting the application.

May 14, Mr. Costesso called asking what he could do about his existing apartment.poke with Jim Gentry and called Mr.Costesso back. I informed him of the provisions and application procedure, he said he would gather the relevant information and come in for an application.
