Was invited to go on an early morning investigation with deputy Chatelain to the above address deputy Chatelain has been getting calls from residents about people living in a shed and a trailer. He thought 6 am would be the best time as they would still be sleeping and we would catch them in the act. Did not see anyone but did see  evidence that people were residing in the shed and a small RV. We decided that deputy Chatelain would contact the person who is calling him as see if there was a better time.

Thursday 22 August. Mr and Mrs Gordon came into the office and gave me copies of the notice of decision and a a land use permit that was issued in 1981.

Monday 19th August Met with Mr Gordon at 8am he would like to put a home on his property and was informing me of a 1981 board of adjustment that granted him a variance. I asked him if he still had the paperwork?

31 July, Received a phone call from Mr. Gordon he wanted to know what he needs to do to remedy the violations. I talked to Jim Gentry Assistant Director about the situation. With what he and I could see, there is no frontage so a single family dwelling could not be built, there isn’t even enough acreage for a flag lot. He might be able to get a special exception if he has an easement or right of way, but he would need to apply.

July 25 Went back to property in the afternoon with heath department personnel. Shut down the R.V. and shed for living. Weber –Morgan Health Department Rules and Regulations Governing Housing Maintenance and Occupancy section 14.1 14.01 – Designation of Unfit Dwellings, Dwelling Units, Rooming Houses, Rooming Units, Dormitories and Dormitory Rooms 14.01.01.01 – Is damaged, decayed, dilapidated, unsanitary, unsafe, and/or vermin infested and/or contains hazardous levels of lead-based paint or other substance. 14.01.01.02 – Lacks illumination, ventilation and/or required sanitation facilities. 14.01.01.03 – The general condition of location is unsanitary, unsafe and/or unhealthful and/or creates a nuisance. 2. Improper disposal of wastewater is a potential health threat and not allowed according to Rule R317-4 – Onsite Wastewater System, Sections 2.4 and 2.6 below: 2.4 – Onsite Wastewater System Required. The drainage system of each dwelling, building or premises covered herein shall receive all wastewater (including but not limit to bathroom, kitchen, and laundry wastes) and shall have a connection to a public sewer except when such sewer is not available or practicable for use, in which case connection shall be made as follows: A. To an onsite wastewater system found to be adequate and constructed in accordance with requirements stated herein. B. To any other type of wastewater system under R317-1, R317-3, R317-5, or R317-560. 2.6. – No Discharge to Surface Waters or Ground Surface. Effluent from any onsite wastewater system shall not be discharged to surface waters or upon the surface of the ground. Sewage shall not be discharged into any abandoned or unused well, or into any crevice, sinkhole, or similar opening, either natural or artificial. Land Use Codes Title 108 Chapter 15 – 1-2 Codes and Standards, and Requirements Of Single family dwelling. Title 30 Public Offences Chapter 5 Offenses involving Refuse or Garbage The shed and the trailer located on this property have been closed to occupancy for the above code violations. Cease and desist occupying these structures and discharging wastewater from the trailer. The “Closed to Occupancy” placards may not be removed and is a violation until the violations have been remedied.

July 25 Did another early morning investigation with deputy Chatelain at 6am and this time we found a young man (24) sleeping in the shed we talked to him and he let us know that he was working at DDO and his step father owned the property. He also informed us that he also slept there several nights a week in the trailer as he worked for disoro in Salt Lake. I informed him that he could not live in a shed with no sanitation or the RV as it was accessory use not a primary use that it was against the land use code, he gave me his step fathers phone number Gordon Hill 1-501-499-2804,I called and talked to Mr. Hill and explained that withouty a primary use he could not park his trailer on his property and he could not allow his step son to live in his shed. He said he understood and I also told him I would be sending a notice to him to remove the trailer and also the junk on the property needed to be cleaned up.
